The following items are taken from New Sunday Times. It is about a question-and-answer session at the elawyer Law Conference 2009 themed “Blogging and Law” recently:

  • You create a fake Facebook profile about your friend or foe, can you get away with it? No. Lawyer Nizam Bashi Abdul Kariem Bashir said the person responsible would be liable for defamation. “The strongest defense for defamation is justification. If you express an opinion and the facts are reasonably accurate and it is published in the interest of the public, then it is acceptable,” said Nizam

  • Someone takes an unflattering photograph of you and posts it on his blog; can you do anything about it? Apparently not. For unflattering photograph, intellectual property lawyer, Foong Cheng Leong said:” So long as it is that person who has taken the photo of you, he has the copyright to it.

  • What about taking a video from YouTube and posting on your blog? “You would have infringed copyright laws as you have reproduced material without consent,” he said.

  • What if someone posts an unfavorable comment about a minister on your blog but you reply to the post saying the comment is inappropriate. Are you liable? “Yes. Your response will help only in the mitigation of your sentencing or damages against you.”

  • On copyright, Foong said if you drew a caricature and commissioned someone else to do illustrations for your blog, you would own the copyright to the caricature and illustrations. “Even if you paid the person just RM1 or RM2 to do it.”

  • If an image is taken of a website and posted on a blog, said Foong, the defense of fair dealing would be available if the website was credited to the proper owner.

  • What if you link your blog to website that contains defamation information or images? The courts, said Nizsm, had held that it was fine if the link just contains the name of the site as opposed to its uniform resource locator.

  • Are you still liable for defamation if you use someone’s name in you blog, and in brackets, explain that it is just an example? “Even if the comments were humorous, parties have still taken matters like this to court. It would depend on the context of the information. Brackets might not necessarily work on all occasions.”

  • Nizam said it was defamation if a blogger's writing injures the reputation of another person.

  • If there is a defamatory comment on a blog but the blogger subsequently removes it, is he still liable? ”Yes. It will only help in the mitigation of sentencing. There is freedom on the Net, but there must also be responsibility.”

Blogging is fun but we have to blog with care in order not to run foul of the law.

An email will be sent to me on a daily basis should my name or my bog is mentioned in the blogosphere.

The whole idea is that you can find out what others are talking about you and your blog in the Internet. When there is a favorable comment about you, you can response quickly to it.

On the other hand at any time when there is a smear about you, you can also act immediately to notify the host of the website to take it down. The faster you response to it the better it is, before there is further damage to your name.

From time to time you can also search the web by typing in your name or your blog title to do a check

Another place to investigate is Technorati. Go to their Watchlists to add the URL of your site, your blog title and your name. You will get similar results like Google Alerts.

Go and find out on the Internet what others are talking about you and your blog.

Say “Hello” to strangers.
Smile at people you meet.
Say "Please" and "Thank you" to counter staff.

Before leaving tell the other person to have a happy day.
Compliment the receptionist that she has a nice head of hair.
Praise your colleague in the office about the dress she is wearing is very attractive and it suits her very well.

These small gestures mean nothing to you but they mean happiness and much more to others. When you bring joy and cheerfulness to the other person the positive impact on you is even greater. Let's find out:

Other studies found that helpful people were less likely to fall ill from chronic disease and tended to have better immune system. Kindness also regulates emotions.

Kindness begets kindness: President Obama helped a stranger who was stranded at the Miami airport without money to pay a $103 luggage surcharge way back in 1988. She paid the $103 back to Obama the day after she arrived in Norway. In return, 2o years later, the woman voted for him and donated 100 dollars to his campaign.

Self-confidence: You build up your self-confidence because you have shown to yourself that you are capable of helping others. And it gives you a sense of self-worth and optimism.

Your own happiness: As the saying goes," Happiness is like jam, you can’t spread even a little without getting some on yourself.” Kindness enhances our feelings of joyfulness.

Relationships: By being kind to others you establish a healthy relationship with them.

As the financial situation is getting from bad to worse, we are now living in a world full of sadness and hopelessness. By spreading kindness around, we bring hope and happiness to others and we build strength in ourselves.

As an example my blog is about self improvement. I want to share ideas with my readers to improve certain aspect of their life like health, money, parenting and other things.

  1. Your title and tagline: Your blog title and the tagline will more or less convey a message to the people about your site’s objectives. From my subtitle I am telling the world that I will blog about self improvement in one’s life in 8 areas.

  1. Your articles: As an example, every article that I post will direct the readers' attention to one area of life to improve for the better. Your articles should be closely related to your niche.

  1. Promote your blog: Get your blog to be noticed by others online and offline:

· Social media: Bookmark your articles at social networking and social bookmarking sites. Obtain backlink to your site by submitting your popular articles to article directories like ezinearticles.com. Join related forums and carnivals. Comment on other similar blogs. Make friends with like-minded people at Face book, Twitter, Plurk…

· Business cards: Include the address of yow website and a small description of your site in your business cards. Hand out your business cards freely to people your come into contact with.

· Newspaper and magazine write-ups: Solicit newspapers and magazine to do write-ups about your blog. The best time to do it is when you have something special happening at your blog or when your blog has reached certain milestone. I will request for a write-up when my blog’s Traffic Rank is in 6 digits or when I have improved my PageRank.

Take the challenge, keep writing every day and over time you will have accumulated a lot of articles and some of them, I am sure, will turn up to be very popular with the readers.

Bookmark your article every day at social networking and social bookmarking sites. Digg, Facebook, Plurk, Stumbleupon Twitter are just a few of them. Website.grader.com is the website that measures your marketing effectiveness. According to the site the algorithm uses a proprietary blend of over 50 different variables, including search engine data, website structure, approximate traffic, site performance and others.

Recently I submitted my site and it gave me a website grade of 75 out of 100. Here are the criteria that it uses to come up with the final score:

1. On-Page SEO

2. Off-Page SEO

3. Blogosphere: It measures your blogging activities which include your blog ranking of Technorati.

4. Social Mediasphere: This measures your involvement in the social networks.

5. Converting qualified Visitors to Leads: It takes into account your RSS feed and conversion form.

6. Competitive Intelligence: It can also track competing websites and see how they are doing, including what they are doing better than you.

Though it is more suitable for those doing e-commerce but it is still applicable to individual blogs to discover their marketing effectiveness

Free Radicals, Antioxidants and Your Health

What are free radicals?

Free radicals mean any atom or molecule that has one or more unpaired electrons. Electrons are normally paired up for stability; hence the molecule with an unpaired electron is highly unstable. Free radicals are formed on the interaction of oxygen with certain molecules in our body. When they are formed they begin a chain reaction and react with important cellular components such as the cell membranes or DNA to cause cells to function poorly or die. Other sources of free radicals are from air pollution, cigarette smoke, alcoholic beverages, ultra violet light, and stress. In order to stop the invasion of free radicals our body has a defense system of antioxidants

What are antioxidants?

Antioxidants neutralize free radicals by supplying missing electron or removing an extra one to restore stability. In our body we have our own antioxidant enzymes but the important micronutrient antioxidants are vitamin E, beta-carotene and vitamin C. In addition, selenium, a trace metal, is needed for the formation of the enzyme glutathione in the defense against free radicals. These micronutrients cannot be manufactured by our body; we need to have a balanced diet to obtain these vitamins

Exercise and free radicals

When you exercise, your oxygen intake increases by 10 to 20 times over the resting state. This greatly increases the amount of free radicals. However, regular physical exercise promotes the antioxidant defense system and protects against free radicals induced by exercise. On the other hand, vigorous exercise, once in while, induces damage to antioxidant defenses resulting in increased free radical damage.

What can you do?

• Eat more fresh vegetables and fruits
• Exercise more frequently ( a few times in a week) but less intensely
• Avoid polluted environment like smoking areas
• control your stress
• Avoid alcoholic beverages
• Give up smoking

Search no further, you can get your desired images for you blog posts easily at http://www.sxc. According to the site it has over 350,000 photos online with more than 30,000 photographers.

You need to register yourself in order to download images. When you are looking at the image you can hold your mouse over it and you can see a larger copy of it. When you want to look for something quickly you go directly to their Advanced Search option and type in the keyword of the images that you are looking for. For example when I key in the word "clover” I will be able to see images of three-leaf and four-leaf clovers.

You need to read carefully their fine print because there are certain restrictions such as selling and redistribution of the images are prohibited.

I have been blogging for more than a year and I keep telling myself that my blog is not a niche blog because I have written about so many things. Just the other day while I was on the way to work and out of the blue I told myself that my blog was actually a niche blog. My blog is all about self improvement. Here are 10 tips that you can start implementing right away so that your child is likable:

  1. When your child comes home: Teach him to tell those in the house especially his parents that he is back. When he goes out your child must tell those at home that he is going out.

  1. Greetings: When your child can speak, teach him such phrases like: “How are you?” “Thank you” “Yes, please”.

  1. Respect the old folks at home: Tell your child to respect elderly people at home by setting good example yourself for your child to follow.

1. Change to a positive mindset will change your luck for the better: Every cloud has a silver lining. All you need to do is to look at the bright side of things. A positive mindset will attract more luck than someone who projects a gloomy outlook. When you expect yourself to be lucky you act successfully and confidently. 9. Instead of saying ‘No’ say “Yes” more often: By saying ‘Yes” you increase the chances of getting new opportunities and find your lucky breaks.

10. Don’t allow the memory of bad luck to haunt you: Don't think that you have encountered a string of bad luck you are doomed to be unlucky. Forget about the past and tell yourself that this is 2009. Act and behave like a lucky guy.
