Blogging and the Law

Law (Stock.xchng)

The following items are taken from New Sunday Times. It is about a question-and-answer session at the elawyer Law Conference 2009 themed “Blogging and Law” recently:

  • You create a fake Facebook profile about your friend or foe, can you get away with it? No. Lawyer Nizam Bashi Abdul Kariem Bashir said the person responsible would be liable for defamation. “The strongest defense for defamation is justification. If you express an opinion and the facts are reasonably accurate and it is published in the interest of the public, then it is acceptable,” said Nizam

  • Someone takes an unflattering photograph of you and posts it on his blog; can you do anything about it? Apparently not. For unflattering photograph, intellectual property lawyer, Foong Cheng Leong said:” So long as it is that person who has taken the photo of you, he has the copyright to it.

  • What about taking a video from YouTube and posting on your blog? “You would have infringed copyright laws as you have reproduced material without consent,” he said.

  • What if someone posts an unfavorable comment about a minister on your blog but you reply to the post saying the comment is inappropriate. Are you liable? “Yes. Your response will help only in the mitigation of your sentencing or damages against you.”

  • On copyright, Foong said if you drew a caricature and commissioned someone else to do illustrations for your blog, you would own the copyright to the caricature and illustrations. “Even if you paid the person just RM1 or RM2 to do it.”

  • If an image is taken of a website and posted on a blog, said Foong, the defense of fair dealing would be available if the website was credited to the proper owner.

  • What if you link your blog to website that contains defamation information or images? The courts, said Nizsm, had held that it was fine if the link just contains the name of the site as opposed to its uniform resource locator.

  • Are you still liable for defamation if you use someone’s name in you blog, and in brackets, explain that it is just an example? “Even if the comments were humorous, parties have still taken matters like this to court. It would depend on the context of the information. Brackets might not necessarily work on all occasions.”

  • Nizam said it was defamation if a blogger's writing injures the reputation of another person.

  • If there is a defamatory comment on a blog but the blogger subsequently removes it, is he still liable? ”Yes. It will only help in the mitigation of sentencing. There is freedom on the Net, but there must also be responsibility.”

Blogging is fun but we have to blog with care in order not to run foul of the law.

Google Alerts, Your Blog and You

Google Alerts
Recently I have created Google Alerts .to check the following key words:

Charles Chua C K
All about living with life

An email will be sent to me on a daily basis should my name or my bog is mentioned in the blogosphere.

The whole idea is that you can find out what others are talking about you and your blog in the Internet. When there is a favorable comment about you, you can response quickly to it.

On the other hand at any time when there is a smear about you, you can also act immediately to notify the host of the website to take it down. The faster you response to it the better it is, before there is further damage to your name.

From time to time you can also search the web by typing in your name or your blog title to do a check

Another place to investigate is Technorati. Go to their Watchlists to add the URL of your site, your blog title and your name. You will get similar results like Google Alerts.

Go and find out on the Internet what others are talking about you and your blog.

What can random acts of kindness do for you?

Kindness (Stock.xchng)
These are random acts of kindness:

Say “Hello” to strangers.
Smile at people you meet.
Say "Please" and "Thank you" to counter staff.
Greet someone on the way to work "Good morning.”
Before leaving tell the other person to have a happy day.
Compliment the receptionist that she has a nice head of hair.
Praise your colleague in the office about the dress she is wearing is very attractive and it suits her very well.

These small gestures mean nothing to you but they mean happiness and much more to others. When you bring joy and cheerfulness to the other person the positive impact on you is even greater. Let's find out:

Health: According to a study of 2016 church members, it was found that those who regularly helped others had better mental health and lower rate of depression. Other studies found that helpful people were less likely to fall ill from chronic disease and tended to have better immune system. Kindness also regulates emotions.

Kindness begets kindness: President Obama helped a stranger who was stranded at the Miami airport without money to pay a $103 luggage surcharge way back in 1988. She paid the $103 back to Obama the day after she arrived in Norway. In return, 2o years later, the woman voted for him and donated 100 dollars to his campaign.

Self-confidence: You build up your self-confidence because you have shown to yourself that you are capable of helping others. And it gives you a sense of self-worth and optimism.

Your own happiness: As the saying goes," Happiness is like jam, you can’t spread even a little without getting some on yourself.” Kindness enhances our feelings of joyfulness.

Relationships: By being kind to others you establish a healthy relationship with them.

As the financial situation is getting from bad to worse, we are now living in a world full of sadness and hopelessness. By spreading kindness around, we bring hope and happiness to others and we build strength in ourselves.

Spread kindness around.

7 Tips to Drive Traffic to Your Blog

You have been blogging for quite a while and the traffic to your blog seems sluggish. Do not despair and do not give up. Here are the 7 tips to help you get more traffic to your blog:

1. The theme of your blog: This is the niche subject of your website. Be very specific about the topic that you are writing about. When your blog is a niche website about a particular topic you will attract more readers to your site. Let's say you are a cat lover and you keep a few at home. You have a lot of things to talk about cats, such as cat food, their habits, how to care for them, diseases of cats and benefits to human beings as pet. For me, my niche is self improvement and from the tagline you will notice the areas that I blog about.

.

2. Rhythm of posting: The readers are expecting and watching. Keep on posting on the dot. When you decide to post an article a day. Do it every day at the same time. Do not turn away your valuable readers by posting irregularly. Once they are gone they are gone forever.

.

3. Compelling articles: Original and unique articles will be noticed by a lot of readers. It is a challenge to write such articles on a regular basis. Take the challenge, keep writing every day and over time you will have accumulated a lot of articles and some of them, I am sure, will turn up to be very popular with the readers.

.

4. Take your articles to where the readers are: Don's expect a new blog to get traffic instantly. You have to take your articles to where the readers are. Bookmark your article every day at social networking and social bookmarking sites. Digg, Facebook, Plurk, Stumbleupon Twitter are just a few of them. Submit your popular articles to article directories such as ezinearticles.com.

.

5. Forums: Depending on you niche you should join forums to express your views in the field of your expertise. For me I will choose to join forums pertaining to self improvement.

.

6. Make friends: Join social networking sites like Facebook, Plurk, and Twitter to make as many friends as possible. Interact with them and introduce yourself and your site to them.

7. Carnivals: Participate in carnivals. Go to blogcarnival.com and join carnivals on the same theme like your blog. You will get readers of similar interest as well as one-way link to your blog.

You cannot expect traffic to surge overnight. It takes time and a lot of daily effort. Make it a habit to do the work. Slowly and steady you will get more and more readers to your site.

Wish you success in blogging!

Decision Making – 5 Vital Steps

Decision making(Stock.xchng)

Life is about making choices. We are making decisions big and small and even when we don’t act, it is also a decision taken by us. Here are the steps to be taken to arrive at a wise decision:

  1. The problem: State the problem clearly and fully. A problem well stated is half a problem solved. Bear in mind also the objective to be achieved.

  1. Gathering information: Get as much information as possible about the problem to be solved.

  1. Alternatives: This is where you need to explore the best course of action. You need to brainstorm, consult others and perhaps sleep over it. Do not be surprise when you sleep over a problem you get the solution to your problem when you wake up the next day. You evaluate each option in terms of its consequences by looking at the pros and cons of each alternative.

  1. Decision and action: Choose the best alternative and transform the decision into specific action steps.

  1. Evaluation: Monitor the effects of your choices. Whenever necessary reassess the situation and make new decisions,

It is often very true that you will not have enough time to do a systematic approach to reach a decision. You may incubate the problem in your subconscious mind and let your intuition decide for you as a way to make a decision.

Free Radicals, Antioxidants and Your Health

What are free radicals?

Free radicals mean any atom or molecule that has one or more unpaired electrons. Electrons are normally paired up for stability; hence the molecule with an unpaired electron is highly unstable. Free radicals are formed on the interaction of oxygen with certain molecules in our body. When they are formed they begin a chain reaction and react with important cellular components such as the cell membranes or DNA to cause cells to function poorly or die. Other sources of free radicals are from air pollution, cigarette smoke, alcoholic beverages, ultra violet light, and stress. In order to stop the invasion of free radicals our body has a defense system of antioxidants

What are antioxidants?

Antioxidants neutralize free radicals by supplying missing electron or removing an extra one to restore stability. In our body we have our own antioxidant enzymes but the important micronutrient antioxidants are vitamin E, beta-carotene and vitamin C. In addition, selenium, a trace metal, is needed for the formation of the enzyme glutathione in the defense against free radicals. These micronutrients cannot be manufactured by our body; we need to have a balanced diet to obtain these vitamins

Exercise and free radicals

When you exercise, your oxygen intake increases by 10 to 20 times over the resting state. This greatly increases the amount of free radicals. However, regular physical exercise promotes the antioxidant defense system and protects against free radicals induced by exercise. On the other hand, vigorous exercise, once in while, induces damage to antioxidant defenses resulting in increased free radical damage.

What can you do?

• Eat more fresh vegetables and fruits
• Exercise more frequently ( a few times in a week) but less intensely
• Avoid polluted environment like smoking areas
• control your stress
• Avoid alcoholic beverages
• Give up smoking

It is by writing and bookmarking my articles that recently one of my articles “Positive Thinking - 10 Delightful Tips to Make You Happy” was discovered by readers of Stumbleupon as a popular article. 10 Ways to Teach Manners to Your Young Child

A young child(Stock.xchng)

Do you envy when you see other children are well-behaved and are very polite?
Here are 10 tips that you can start implementing right away so that your child is likable:

  1. When your child comes home: Teach him to tell those in the house especially his parents that he is back. When he goes out your child must tell those at home that he is going out.

  1. Greetings: When your child can speak, teach him such phrases like: “How are you?” “Thank you” “Yes, please”.

  1. Respect the old folks at home: Tell your child to respect elderly people at home by setting good example yourself for your child to follow.

  1. Polite behavior: Teach your child to look at the person in the eyes when someone is talking to him. Do not raise his voice when he is talking to an adult. Do not interrupt when the adults are talking.

  1. Entertaining guests at home: It is a good opportunity to show your child the right ways to treat the guests in the house. Upon arrival of the guest teach the child to smile and greet the guests. Teach him to offer food and drink to the guests. When there are young children your child should share his toys and have fun with them.

  1. Smile: Teach your child to smile at others. It is an international language for friendliness.

  1. Always say “Hi”: Teach your child to say hello to his teachers, relatives and friends.

  1. Socializing with other children: Allow your child to mix freely with other children. This is a good way for him to learn by himself to get along with others.

  1. Visiting: This is another good opportunity to show your child the correct way to greet the people that you are visiting. Teach him the appropriate greetings during festive seasons.

  1. Table manners: Tell your child to wash his hands before eating. Teach him the correct behavior while dining with adults.

You child is also leaning from you. He will follow the way you talk to your neighbors and the way you treat people. When you treat people politely he will in turn treat you and others just as polite.

How Lucky Can You Get in 2009? 10 Lucky Tips to Boost Your Luck

4-leaf clover (stock.xchng)
According to Dr. Richard Wiseman, a psychiatrist who has researched luck and its causes reveals that people aren’t born lucky or unlucky, the main difference lies with each person’s attitude and outlook. In his book, The Luck Factor - The Four Essential Principles, he mentions that if you want to improve your luck you should:

• Maximize your chances

• Listen to your instincts

• Expect to be lucky

• Look on the bright side

Accordingly, here are the 10 tips to improve your luck:

1. Change to a positive mindset will change your luck for the better: Every cloud has a silver lining. All you need to do is to look at the bright side of things. A positive mindset will attract more luck than someone who projects a gloomy outlook. When you expect yourself to be lucky you act successfully and confidently. What the mind can conceive and believe, the mind can achieve-with PMA. These are the wise words of Napoleon Hill and W. Clement Stone.

2. Your gut feelings: Listen to your intuition. It helps you avoid bad situations and maximize your chances. Do you have such instances when you wake up in the morning you have the solution to the problem that you thought very hard about it the night before?

3. Do things differently: As an example I always use a 728x90 Leaderboard ad block on top of the page and the results are poor but when I change to a 336x280 Large Rectangle block which I have never done before, my AdSense earnings improve.

4. Luck is what happens when preparation meets opportunity: When you have an idea go ahead and do it. For instance I write and post an article a day, all of a sudden one of my articles is a big hit with Stumbleupon . If I hadn't written continuously I wouldn't be lucky enough to come up with a popular article at all.

5. Stop worrying: Be relaxed and be alert at the things happening near you. When you are calm you will be able to spot opportunities.

6. Meet more people: It goes without saying that meeting more people or networking offers the greatest opportunity to get lucky breaks. I get to know more people by joining Facebook. And I am lucky enough to know a few who are kind enough to enlighten me about blogging.

7. Do it now: Nothing is going to happen if you don't act. You may fail but you don’t do it you don't even stand a chance to succeed. According to W. Clement Stone: “If there is nothing to lose by trying and a great deal to gain if successful, by all means try. Do it now!” For example, my article wouldn’t be popular if I didn’t bookmark it at Stumbleupon.

8. Ask for it: When you want something you ask for it. If you don't ask you don't get it. When you ask for it you may get overwhelming response.

9. Instead of saying ‘No’ say “Yes” more often: By saying ‘Yes” you increase the chances of getting new opportunities and find your lucky breaks.

10. Don’t allow the memory of bad luck to haunt you: Don't think that you have encountered a string of bad luck you are doomed to be unlucky. Forget about the past and tell yourself that this is 2009. Act and behave like a lucky guy.

Your luck is very much within your control. Just lift your spirits and look at life with a positive mental attitude and you will be lucky.

Wish you the very best of luck!
